Precedent-setting decisions affecting the character of Delaware’s National Scenic Byway begin today, when the proposal to develop Wagoner’s Row is to be considered by the New Castle County Planning Board.http://en.wikipedia.org/wiki/Delaware_Byways
The application proposes (1) to amend the Comprehensive Plan, (2) to subdivide a Carpenter family estate to include 12 approximately 1 ⁄3-acre lots for single family homes along Del. 100, and (3) to rezone these 12 acres from Suburban Estate to Suburban Option-2. It is the first such proposal since the 2005 designation of Del. 100 and Del. 52 as a National Scenic Byway,

Delaware’s first and only National Scenic Byway.
Questions raised by this proposal include whether the Comprehensive Plan should be amended on an ad-hoc basis and whether supporting ordinances should establish what deed restrictions, setbacks, building heights, density and landscaping requirements are instituted along the Scenic Byway. The answers affect future developments along the Byway and the gateway to Delaware’s recently designated National Park. Undoubtedly, other property owners along the Scenic Byway will follow precedents set by this hearing and by subsequent New Castle County Council and executive actions.
While recognizing the right and need of families to divest themselves of valuable assets, we should not squander Delaware’s great legacies such as the vistas of the Scenic Byway. I urge all interested Delawareans to express their insights at the [New Castle County Planning Board] hearing at 7 tonight in the Corporate Commons’ James Gilliam Building at 77 Reads Way in New Castle.

Ord. 13-047 will rezone 12.01 acres from SE (Suburban Estate) to S (Suburban) and will amend the 2012 Comprehensive Plan consistent therewith. CD 2
