Delaware Sierra Club writes ~ Yes, Unfortunately we do currently have tar sands coming through NCC en route to the Delaware City Refinery. They make a stop for "staging", aka waiting to get into the refinery yard and offloaded, in Newark right to the proposed power plant on the UD Star campus.   I was reading up on the Chrysler factory debate here in Newark and overheard a co-worker say “It’s doesn’t really matter who bids on the project, if the U of D wants it they can take it”.

  • Phillip Bannowsky Ok, so the law reads, " to better carry out the purposes of the University and agricultural experiment station, the University, in the exercise of the power of eminent domain, may acquire the land and improvements by condemnation by proceedings." However, what if private entities that partner with UD benefit from the cheap price UD paid for the Chrysler land by threatening eminent domain? According to the News Journal (24 Oct 2009), “[i]n a footnote in the bankruptcy court filing, attorneys for Chrysler noted that other potential purchasers may have been reluctant to ‘take the risk’ of buying the property because UD had the possibility of gaining the land, under state law, through eminent domain and has publicly indicated a willingness to use such rights [of a public enterprise] to secure the property.’”

    
    
  • Phillip Bannowsky I have sometimes wondered if someone who wanted to use the Chrysler plant with a large blue-collar workforce was scared off, but of course the Fisker debacle makes that seem less likely.
