Rumors from a reliable source are flying that Mayor Dennis Williams is in talks with Jim Baker and Ted Blunt about taking jobs in his administration. 

If true, that means that Williams is serious about getting all possible hands on deck to straighten out the city's woes. Very interesting and positive.

More than 200 local residents turned out Tuesday night for a town hall meeting soliciting comments on a proposal from Data Centers LLC to construct a 900,000 square foot facility that includes a 248-megawatt generating facility. Many of those residents took turns speaking about the matter in the Newark High School auditorium, with the large majority of them expressing displeasure over the plan because of its controversial power supply.

........Among those who spoke during the meeting was Amy Roe, a Siera Club member who also lives less than a mile from where the $1 billion facility would be located.  Roe is worried about noise and environmental pollution created by the power generating facility, which would be powered with natural gas. "This is a project that would emit fine particulates. It would emit ammonia, a lot of things into the environment that haven't yet been talked about," 

........The university also announced on Tuesday that it had created a working group including several college deans to review the proposal.  The committee plans to "engage independent third-party engineering consultants, who will review the technical plans," according to a news release on the university's website. Resident Anne Murray, who worked in the information-technology sector for a decade, cautioned the crowd about counting on those extra positions. “That data center is going to be a ghost town. Someone across the world can log in remotely and maintain those servers from far way,” Murray said. 

Murray also said it would be likely that TDC LLC would contract with a firm like Hewlett Packard to maintain the servers locally - the work would not be done by TDC employees. So what would TDC hire people on site to do, exactly? Find clients for cloud computing? 

(Newark Post) Karie Simmons reports ~ Discussion, protests continue over proposed power plant

Tuesday night at a town-hall meeting on the power plant at Newark High School, Morehead said that council received new legal advice on Tuesday that TDC does not have the authority to sell excess electricity to its tenants unless the city gives the company permission. Possible tenants of the data center include banks, websites such as Google and Facebook and universities like UD.
“Yesterday I would have said we have a 20 percent of stopping this,” Morehead said. “Today, based on the legal advice, I’m pretty sure we’ve got a 99 percent chance of getting their attention.” He said the information is so new that council has not been having the conversation long enough for him to know what the next steps are, adding that they are in “uncharted territory. This gives us leverage,” Morehead said. “It is so new we don’t know how to use that leverage.”
Neither City Solicitor Bruce Herron nor City Manager Carol Houck could be reached for comment.
Morehead made it clear to the crowd Tuesday night that those who oppose the project are not fighting an uphill battle, to which many residents erupted with applause.
“I think we’ve managed to even the playing field,” he said. “What I’m saying is, you’re back in the game.”

With a comment rescue ~

The university under the new administration continues to try to run rough shod over the city. Traffic is horrendous from student cars and university vehicles. Do they pay their fair share toward maintnenance and improvements. They forced lower electric rates by threatening to sue the city and as a result my rates went up 17%. UD's rates were the lowest in the county and now they are lower. Now they want to build a power plant and I guarantee you that UD will be a major customer of excess power, if not the only one. What happened to the City's charter regulation that all entities within the City must buy their electricity from the City. Electricity sales are a major source of revenue and capital funds. I wuold love to see the sweet heart deal they have ready to go. Of course UD is not subject to FOIA. How many of UD's highly paid administrators live in Newark? Not many.

He addressed opposition to the data center project, saying that “We have had to battle in some ways citizens who are waiting to fight these opportunities, these growth opportunities.
Mr. Levin's dismissive atitude toward the legitimate concerns of those residents surrounding the proposed power plant is painfully apparent in Mr. Levins words. The cavalier attitude and the snide and suspicious assumption that "citizens are waiting to fight these opportunities" implies a total lack of respect for the property rights and property values and quality of life that may be disaffected by this project. My biggest objection, however, is to the insensitivity and utter lack of tact expressed toward my constituents by Secretary Levin. His presumption that there is some sort of organized 'sconspiracy to thwart economic growth should either be accompanied by factual evidence or seen as what it is; "a sublime touch of paranoia". Regardless I believe Mr. Levin owes my constituents either an apology or rebuttal of his quote.

No Newark Power Plant blog asks a great question ~ UD is a national leader in solar energy, so why build a fossil fuel power plant?

There was a full house at the Newark City Council meeting last night. Most of the audience were No Power Plant proponents. A few spoke. I said that they now own Max Walton's opinion which hinges on legislative intent to allow a power plant by virtue of having approved the special UD STAR Campus zoning.  

Jen Wallace told Council that they must do something and it was in their power. Amy Roe told them that even though the PSC has no authority, the Council has a duty to act as the oversight authority over the utility. John Kowalko announced tonight's 6:30PM Town Hall at Newark High School.


Also, Rick Jensen doesn't have his interview with Jack Markell yesterday up in a podcast on the WDEL. I sent him an email asking if was going to make it available.

Meanwhile from Amy Roe - 

Governor Markell just said on the radio that the Data centers power plannt "is not a done deal" and that it would need to meet the requirements of the city of Newark.

 He also said "it would be a big win".

He and Rick Jensen (the radio show host) were talking about our football banner at Saturday's game.

Rep. Kowalko is on now setting Gov. Markell straight and asking him to come to the town hall meeting. Gov Markell said he can't make it.

Markell is now trying to make this into a jobs only issue.

And speaking directly to the jobs problem ~ The STAR campus is a brownfield because no one thought ahead

My statement was written in response to someone claiming to be a union member welcoming the TDC project to the state (you can see the statement on the Delaware Way blog-NNPP editor) . They claimed that it was a better and more environmental use of a brownfield site and those who opposed the project were personally responsible for finding and/or funding a replacement project. The gist of the argument justifying these positions was that since the wages would generate an influx of cash to the state, the only thing that mattered was the jobs the project would create. Not necessarily union jobs, though I guess that might be why the person claimed union membership, or even good jobs. Just jobs.

My reply:
I believe in unions and I believe in union jobs. I’ve been in them and I’ve had them. Because I have, because I do, because thanks to unions I enjoy a forty-hour workweek, an eight-hour day, sick pay, holidays, a pension, a healthy and safe work place and more things than I can repeat or remember, I also don’t believe that any job is necessarily a good job. If you just want a job, you don’t need a union. This project is nothing more than a job that will keep some people employed for a few years and then they’ll be back on the street again. You want a good job, you need a union and to recognize there is more at stake than just a paycheck.
Getting a good job means going after a government that isn’t concerned to maintain or improve infrastructure and public facilities. It means going after the big business’ enjoying record profits who don’t give any of it back to the people that make it for them or invest in the communities where they live, who ship jobs overseas to people forced to work for little pay in conditions worse than any our ancestor’s faced. It means going after the University who are going to buy steam from this thing and probably need a lot fewer unionized boiler mechanics as a result.
This thing isn’t going to bring lots of jobs to the area. The whole point of cloud computing, and this is a data center meant for the cloud, is that physical location doesn’t matter. Why build here when you can access what this thing has to offer from wherever you are right at the moment? Computers that can be monitored and run from somewhere else do the work and all they need people for is the digital equivalent of fetch and carry. And it doesn’t take many to do that.
Ask the people down in Maiden, NC who were promised 250 jobs with Apple’s new facility and got 50. This Washington Post article  about Maiden sums it up: “the overall benefits [data centers offer] for communities … are fleeting”.
Unions use to recognize that making work better built a better world. Samuel Gompers said strong unions help protect the rights of the people. I live less than half a mile away from this place. I work hard to keep my house in good shape. Where’s the value of my labor if my house becomes worth a lot less just because this thing goes up? I work hard at my job. Where’s my rest and recreation when I can’t sit in my yard and enjoy a beer at the end of the day without having this thing whining and grinding in the background? My wife has chronic asthma. What’s fair about telling her or my eight-year-old daughter they have to stay inside because this thing has caused a lot of smog? Who’s fighting for their rights? Who’s fighting for me?
The STAR campus is a brownfield because no one thought ahead about what they built and did there would do to the area.
Or even really cared much either. Now people are trying to stop something that will spread a lot of pollution over a much larger area (to say nothing of the hazards of the ammonia and natural gas they’ll have to store on-site and right next to an active switch yard no less) and you want to hold that against them?
No, I don’t have the money to develop this patch of brownfield. And I have no easy answers or quick fixes about how to.
But why do we need this particular thing to be built on the STAR campus in the middle of 30,000 people?
Because it’s here and now, a quick fix of cash?
Look around. Why is the STAR campus a brownfield? All easy answers or quick fixes get you is a mess down the road because they’re all about where you are now, not where you’re going to be later. Isn’t that exactly what made the problem? We all need better jobs. We all need a better world. There’s no easy way to get them. Yet unions are proof solidarity can get you both, to some extent.
We’d all do better holding one another up.
It might be your neighborhood next or you on the picket line looking for someone to help put more pressure on the boss. After all, any job is not always a good one, for you or for anyone else.

Another Year of Shortsighted and Counterproductive Cuts Will Make It Worse

Newark, DE– Three years after the recession ended, the economy still isn’t working for most people, around the nation or here at home in Delaware. New Census Bureau date shows that nearly 1 in 8 people in Delaware are living in poverty -- a big increase from 2008 when only 1 in 10 were poor. The income of the top 1 percent grew by 31.4% over the last 3 years, while the incomes for 99 percent of American’s grew only by 0.4%.

Congress must choose to make investments, instead of further slashing human needs programs and prioritizing multi-national corporate interests.

 “Congress has choices to make about our country’s priorities,” said Ezra Temko, Delaware organizer for Americans for Democratic Action.  “Cuts to programs like SNAP are dangerous for Delaware residents and our fragile economy.  They are unnecessary for deficit reduction and just bad policy.  It’s time for Congress to stop the sequester cuts and make choices that invest in our communities.”  

While the recession officially ended in June of 2009, the economy still is deeply troubled. Poverty is higher today than it was in 2008, the first full year of the recession, according to a new report by Delaware ADA and the Coalition on Human Needs. New Census Data Confirms Delaware’s Economy Isn’t Working documents how poverty impacted people in Delaware and what policy choices could reduce poverty rates in future years. Produced by the Delaware group, the brief report also provides examples of how across-the-board sequestration cuts are already threatening individuals, families and the fragile economic recovery.

Top Five Findings:

• Households in Poverty: Almost 1 in 8 people in Delaware are living in poverty -- a big increase from 2008 when only 1 in 10 were poor. The number of those living in near-poverty also has grown; today nearly one-third of Delawareans live under twice the poverty income level (below $36,568 for a three-person family).

• Kids: In Delaware, one out of three Hispanic children and one out of four Black children are growing up in poverty.

• Unemployment: Today, more than four years after the recession officially ended, unemployment stands at 7.3% in Delaware.  One out of seven Delawareans are unemployed or underemployed—that includes those who can’t find enough hours of work and those who have given up looking for work.

• Food Insecurity: Here in Delaware over the past three years, more than one in nine were food insecure.

• Housing: The Census data released Thursday shows that 43.1% of renters pay more than 35 percent of their income in rent, the official definition of families overburdened by rent costs.  Today, 39% of households are overburdened by rent costs.

Al Lawler stands with the national POW/MIA flag for POW/MIA Recognition Day, a day to remember prisoners of war and those still missing in action. Lawler helped coordinate a 24-hour event on Academy Lawn last Friday to help raise awareness of missing soldiers.

For 24 hours last Friday, a group of soldiers, veterans, VFW members and other military supporters huddled in a circle on the Academy Lawn, said a prayer and lit a candle each hour.
The service was in observance of National POW/MIA Recognition Day, a day to remember prisoners of war and those still missing in action. The day is observed across the nation each year on the third Friday of September. 

Al Lawler, who helped coordinate the event, served in the Korean War and comes from a military family, so he said the day really hits home for him. “I'm American as hard as you can get,” he said. “This day means to bring the guys home.”

As of April 2009, there were 1,741 Americans listed by the Defense Department's POW/MIA Office as missing and unaccounted for from the Vietnam War. Of those still missing, most were lost in Vietnam or areas of Laos and Cambodia.

Coons Joins Senate Judiciary Committee Demand For Review Of Surveillance Authorities

WASHINGTON (Monday, Sept. 23, 2013) – A bipartisan group of nine Senate Judiciary Committee members, led by Chairman Patrick Leahy (D-Vt.) and Ranking Member Chuck Grassley (R-Iowa), sent a letter Monday calling for the inspector general of the intelligence community to conduct a full-scale review of the use of surveillance authorities and make public the findings.

Specifically, the Senators are asking for detailed information on the surveillance of Americans under FISA and Patriot Act authorities and any misuse of these authorities over the last three years. Other Senators who joined the letter include: Sen. Chuck Schumer (D-N.Y.), Sen. Sheldon Whitehouse (D-R.I.), Sen. Chris Coons (D-Del.), Sen. Richard Blumenthal (D-Conn.), Sen. Mike Lee (R-Utah), Sen. Ted Cruz (R-Texas), and Sen. Jeff Flake (R-Ariz.).

 

“We urge you to conduct comprehensive reviews of these authorities and provide a full accounting of how these authorities are being implemented across the Intelligence Community,” the Senators wrote. “The IC Inspector General was created in 2010 for this very purpose.  Providing a publicly available summary of the findings and conclusions of these reviews will help promote greater oversight, transparency, and public accountability.”

 

The bipartisan letter is part of the Committee’s continuing oversight in this area.  The Committee held a high-profile hearing in July featuring testimony from top administration officials. Leahy, who will deliver a keynote address at Georgetown University Law Center on Tuesday about national security and surveillance programs, recently announced that the Committee will hold an additional hearing next week featuring testimony from Director of National Intelligence James Clapper and Gen. Keith Alexander, Director of the National Security Agency.

Recent disclosures about classified government surveillance activities have generated significant public discussion about the breadth of these programs, many of which are conducted pursuant to the Foreign Intelligence Surveillance Act (FISA), and the need for appropriate oversight and checks and balances.

 

In particular, concerns have arisen about activities conducted under Section 215 of the USA PATRIOT Act and Section 702 of FISA, which was enacted as part of the FISA Amendments Act of 2008.  Recently declassified documents appear to reveal numerous violations of law and policy in the implementation of these authorities, including what the FISA Court characterized as three “substantial misrepresentation[s]” to the Court.  These declassified documents also demonstrate that the implementation of these authorities involves several components of the Intelligence Community (IC), including the National Security Agency, Department of Justice, Federal Bureau of Investigation, Central Intelligence Agency, and the Office of the Director of National Intelligence, among others.

 

We urge you to conduct comprehensive reviews of these authorities and provide a full accounting of how these authorities are being implemented across the Intelligence Community.  The IC Inspector General was created in 2010 for this very purpose.  Comprehensive and independent reviews by your office of the implementation of Sections 215 and 702 will fulfill a critical oversight role.  Providing a publicly available summary of the findings and conclusions of these reviews will help promote greater oversight, transparency, and public accountability.

 

In conducting such reviews, we encourage you to draw on the excellent work already done by the Inspectors General of several agencies, including the Department of Justice, in reviewing these authorities.  But only your office can bring to bear an IC-wide perspective that is critical to effective oversight of these programs.  The reviews previously conducted have been more narrowly focused – as might be expected – on a specific agency.

In particular, we urge you to review for calendar years 2010 through 2013:

 

·         the use and implementation of Section 215 and Section 702 authorities, including the manner in which information – and in particular, information about U.S. persons – is collected, retained, analyzed and disseminated;

 

·         applicable minimization procedures and other relevant procedures and guidelines, including whether they are consistent across agencies and the extent to which they protect the privacy rights of U.S. persons;

 

·         any improper or illegal use of the authorities or information collected pursuant to them; and

 

·         an examination of the effectiveness of the authorities as investigative and intelligence tools.

We have urged appropriate oversight of these activities long before the problems with the implementation of these FISA authorities became public.  We believe it is important for your office to begin this review without further delay. 

 

Please proceed to administratively perform reviews of the implementation of Section 215 of the USA PATRIOT Act and Section 702 of FISA, and submit the reports no later than December 31, 2014.  Thank you in advance for your efforts to ensure a full accounting of the implementation of these surveillance authorities across the Intelligence Community.
