This is to remind you that on Thursday, November 21, 2013 at 2:00 p.m. in the New Castle County Courthouse, Wilmington, DE the case of Pike Creek Recreational Services v. New Castle County will be heard (former Three Little Bakers golf course property.) It is our understanding that this hearing will deal with 2 issues: a Rule 60 hearing, as well as a clarification of the original order.
The Rule 60 order was filed by Pike Creek Recreational Services (PCRS) as a response to the County Attorney's quote that "Council is not a named client in this suit". This newly appointed attorney based his statement on the fact that the Plaintiff is simply listed as New Castle County. PCRS's recently filed order asks for Deconsolidation of Action and for a Substitution of Real Party In Interest Pursuant to Rule 17(a).
Our outside Counsel, Max Walton, has written to the Court stating that under Title 9 of the State Code, County Council may not generally bring suit in its own name, but this same Title requires that suit be brought in the name of the "County" and County Government, within the State Code, is defined as County Council.
The second portion of this hearing is New Castle County's request for clarification and/or limited re-argument of portions of the Court's September 5, 2013 opinion. It requests clarification on the set aside of no less than 130 acres for the specific use of development of an 18 hole golf course...and that golf course must be a parcel of land of sufficient quantity, quality and configuration to meet that specific purpose.
We are arguing that the only way that the County can determine if the golf course requirement is satisfied is through the submission of a code compliant golf course plan.
